Terms and Conditions

Welcome to Project Tracker. By accessing or using our platform at projecttracker.au, you agree to be bound by these Terms and Conditions. Please read them carefully before using the service.

The following terminology applies throughout this document: "Client", "You" and "Your" refers to you, the person or business accessing this platform. "The Company", "We", "Our" and "Us" refers to Project Tracker. "Service" refers to the Project Tracker platform and all associated features.

Subscription & Payment

Access to Project Tracker is provided on a subscription basis. By subscribing, you authorise us to charge your nominated payment method on a recurring basis in accordance with your selected plan.

  • Subscription fees are billed monthly or annually depending on your chosen plan.
  • All fees are in Australian Dollars (AUD) and are inclusive of GST where applicable.
  • Payments are processed securely via Stripe. Project Tracker does not store your card details.
  • Subscription fees are non-refundable except where required by Australian Consumer Law.
  • We reserve the right to change pricing with at least 30 days' notice to your registered email address.
Automatic Renewal Your subscription will automatically renew at the end of each billing period. You may cancel at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period.

Account Restriction for Non-Payment

We understand that payment issues can arise. The following process applies when a subscription payment is unsuccessful or overdue:

Day 1 — Payment Due
Your subscription payment is attempted on the scheduled billing date. If successful, full access continues uninterrupted.
Days 1–7 — Grace Period
If payment fails, your account remains fully active for 7 days. You will receive automated email notifications asking you to update your payment method. Additional retry attempts will be made automatically.
Days 8–30 — Restricted Access
After 7 days without successful payment, your account will be placed in read-only mode. You can still view existing data, projects, purchase orders, and reports, but you will not be able to create, edit, or delete records until payment is resolved.
Day 31–60 — Account Suspended
After 30 days of non-payment, your account will be fully suspended. Login will be disabled for all users associated with your business account. Your data will be retained securely during this period.
Day 61 onwards — Data Deletion
If payment is not received within 60 days of the original due date (approximately 2 months), your account and all associated data will be permanently deleted. See the Data Deletion Policy section below for full details.
Reactivation You may reactivate your account at any time before data deletion by settling any outstanding balance and resuming your subscription. Once reactivated, full access is restored immediately. Contact support@projecttracker.au to arrange reactivation.

Data Deletion Policy

Permanent Deletion After 2 Months of Non-Payment If a subscription payment remains unpaid for 60 days or more, all data associated with your account will be permanently and irreversibly deleted. This action cannot be undone.

What data is deleted

Upon account deletion due to non-payment, the following data will be permanently removed from our systems:

  • All business and project records, including project details, budgets, cost categories, and timelines
  • All purchase orders, invoices, work orders, and financial records
  • All employee records, HR documents, timesheets, and check-in/check-out logs
  • All uploaded documents and files stored on our servers
  • All user accounts associated with the business
  • All client, supplier, and contact records
  • All variation registers, defect registers, and site visitor logs

Notification before deletion

We will send a minimum of three (3) email notifications to the account owner's registered email address before data deletion occurs:

  • At 7 days overdue — initial payment failure notice
  • At 30 days overdue — account suspension warning
  • At 53 days overdue — final deletion warning (7 days before deletion)

It is the account owner's responsibility to ensure their contact email address is current and that our emails are not filtered as spam.

Data export before deletion

We strongly recommend exporting your data before your account is suspended. You may contact us at support@projecttracker.au to request a data export at any time while your account is active or in restricted mode. Data export requests are not available once an account has been fully suspended.

Voluntary account cancellation

If you choose to cancel your subscription voluntarily, your data will be retained for 30 days after the end of your final billing period. After this period, your data will be permanently deleted. You may request earlier deletion by contacting us.

Cookies

We use cookies to maintain session state, remember your preferences, and improve platform performance. By using Project Tracker, you consent to our use of cookies in accordance with our Privacy Policy.

Intellectual Property & License

Unless otherwise stated, Project Tracker and its licensors own all intellectual property rights in the platform and its content. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes during your active subscription period.

You must not:

  • Republish, sell, rent, or sub-license any part of the platform or its content
  • Reproduce or copy material from Project Tracker for commercial purposes
  • Attempt to reverse engineer, decompile, or disassemble any part of the platform
  • Use the platform in any way that violates applicable laws or regulations

User Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • Ensuring all users added to your account comply with these Terms
  • The accuracy of all data entered into the platform
  • Keeping your billing and contact information up to date
  • Complying with all applicable laws in your jurisdiction when using the platform

Content Liability

Project Tracker is a platform for managing your construction project data. We are not responsible for the accuracy, completeness, or legality of any content you upload or create within the platform. You agree to indemnify and hold us harmless against any claims arising from your use of the platform or content you submit.

Your Privacy

Your use of Project Tracker is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection and use of your information as described in the Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Project Tracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the platform.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you in the 3 months immediately preceding the event giving rise to the claim.

Reservation of Rights

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by a notice within the platform at least 14 days before the changes take effect. Your continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

We also reserve the right to suspend or terminate access to the platform for any account that violates these Terms, engages in fraudulent activity, or poses a security risk to the platform or other users.

Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
